State releases list of drilling chemicals

Compounds associated with serious health effects are among those being used to drill gas wells.

HARRISBURG — More than two years after the start of a natural gas drilling boom, Pennsylvania is making public what environmental regulators dub a complete list of the chemicals used to extract the gas from deep underground amid rising public fears of potential water contamination and increased scrutiny of the fast-growing industry.

Compounds associated with neurological problems, cancer and other serious health effects are among the chemicals being used to drill the wells, although state and industry officials say there is no evidence that the activity is polluting drinking water.

The Associated Press obtained the list from the state Department of Environmental Protection, which assembled what is believed to be the first complete catalog of chemicals being used to drill in the Marcellus Shale. The department hopes to post it online as soon as Wednesday, according to spokesman Tom Rathbun.

It counts more than 80 chemicals being used by the industry in a process called hydraulic fracturing, or “fracking,” as it pursues the gas in the mile-deep shale.

Environmental advocates worry the chemicals are poisoning underground drinking water sources. However, environmental officials say they know of no examples in Pennsylvania or elsewhere.

“If we thought there was any frack fluid getting into fresh drinking water … I think we’d have to have a very serious conversation about prohibiting the activity completely,” said Scott Perry, the director of the department’s Bureau of Oil and Gas Management.

Conrad Volz, who directs the University of Pittsburgh’s Department of Environmental and Occupational Health, said state and federal agencies haven’t done enough research to come to that conclusion.

Dr. Thomas Jiunta, a podiatrist from Lehman Township who founded the Gas Drilling Awareness Coalition, predicted DEP’s list would be incomplete and that it would not provide concentrations of chemicals used in fracking fluids. He referred a reporter to Theo Colburn, who has been conducting research on the effects of fracking chemicals.

Colborn, who founded The Endocrine Disruption Exchange, a Colorado non-profit that studies health and environmental problems caused by low-dose exposure to chemicals that interfere with development and function, said the list of chemicals is “the longest list (that she’s seen) provided by any government agency.”

But, said Colborn, whose degrees include pharmacy, epidemiology, toxicology and water chemistry, the list does not contain Chemical Abstract Services registry numbers, which aid in identifying the chemicals through databases. And several items on the list are classes of chemicals rather than individual chemicals.

“Glycol ethers – see, here you have a general term again. There are many glycol ethers. In our spreadsheets, you wouldn’t find anything so general,” Colborn said, scanning the list. “And Oil Mist – what is that?” she said.

Colborn also said the concentrations of the chemicals in the fracking fluids should be divulged because it’s the only way medical personnel and scientists can determine the dosage of chemicals when treating someone exposed to them or when researching the long-term effects of exposure or consumption if the chemicals ended up contaminating a water supply.

Industry advocates say the concentrations of chemicals in fracking solutions must remain trade secrets.

Many of the compounds are present in consumer products, such as salt, cosmetics, ice cream, gasoline, pesticides, solvents, glues, paints and tobacco smoke.

A decades-old technology, hydraulic fracturing was coming under increased scrutiny even before the Gulf of Mexico oil spill.

Its spread from states such as Texas, Colorado and Wyoming to heavily populated watersheds on the East Coast has led to worries about water contamination and calls for federal regulation.

Hydraulic fracturing is exempt from the federal Safe Drinking Water Act, leaving states to regulate the activity. In New York state, regulators have effectively held up drilling on the Marcellus Shale while they consider new regulations. Last year, they published a list of more than 250 chemicals that could potentially be used there.

In Pennsylvania, where approximately 1,500 Marcellus Shale wells have been drilled and many thousands more are expected in the coming years, the state is working to buttress its regulations even as rigs poke holes in large swaths of the state.

Pennsylvania assembled the list in recent months from information the industry is required to disclose and decided to prepare it for the public as public interest grew, Perry said.

Industry officials say the chemicals pose no threat because they are handled safely and are heavily diluted when they are injected under heavy pressure with water and sand into a well. Industry officials say the chemicals account for less than 1 percent of the fluid that is blasted underground.

The mixture breaks up the shale some 5,000 to 8,000 feet down and props open the cracks to allow the gas trapped inside to flow up the well to the surface.

One compound, naphthalene, is classified by the federal Environmental Protection Agency as a possible human carcinogen.

The EPA said central nervous system depression has been reported in people who get high levels of toluene by deliberately inhaling paint or glue.

In its online guidelines on xylene, the U.S. Occupational Safety and Health Administration cites an industrial hygiene and toxicology text that says chronic exposure to xylene may cause central nervous system depression, anemia, liver damage and more.

The chemicals are used to reduce friction, kill algae and break down mineral deposits in the well. Various well services firms make different proprietary blends of the solutions and supply them to the drilling companies, which blend them with water at the well site before pumping them underground.

In recent years, some makers of the solutions have sought to replace toxic ingredients with “green” or food-based additives. For instance, Range Resources Corp., one of the most active drilling companies in Pennsylvania, is close to rolling out a 100 percent biodegradable friction reducer, spokesman Matt Pitzarella said Monday.

State tells drillers to follow the rules

State DEP chief talks about protecting water supplies in the Marcellus Shale areas.

HARRISBURG – State Department of Environmental Protection Secretary John Hanger laid down the law to representatives of oil and gas companies drilling in the Marcellus Shale at a meeting he called on Thursday.

New proposed environmental regulations affecting the natural gas industry will be presented to the state Environmental Quality Board at the next meeting, which is at 9 a.m. Monday in Room 105 of the Rachel Carson Office Building, 400 Market St., Harrisburg.

More precisely, he laid out two sets of proposed regulations for natural gas drilling procedures and responding to reports of contamination of water supplies – proposed regulations that members of the oil and gas industry helped create.

“There were technical discussions on how to prevent gas migration from (natural gas) well sites to water wells and what to do if migration does occur and how to respond,” Hanger said in an interview from his cell phone as he was riding to Dimock after the meeting in Harrisburg.

Hanger was on his way to an interview with ABC News at the site of a natural gas well that Cabot Oil & Gas capped under DEP order after the regulatory agency determined it was one of three that leaked methane, contaminating the well water supplies of at least 14 households in the rural Susquehanna County village.

“I challenged the industry. … I made it clear that regulations would be enforced,” Hanger said, noting that DEP opened two new field offices in Northeastern Pennsylvania in response to Marcellus Shale development and is doubling its enforcement staff. “I also made it clear we were strengthening the rules,” he said.

DEP spokesman Tom Rathbun said in a separate interview that the new drilling regulations would require specific testing according to standards of the American National Standards Institute on steel casing used in all high-pressure oil and gas wells as well as the use of “oil-field grade” cement in well construction.

Rathbun said the oil and gas industry supports the implementation of those standards, and most companies already employ those practices under best-management practices. The goal is to have all companies comply, and Hanger asked the industry to voluntarily comply immediately, rather than wait until regulations receive all necessary approvals, which are expected in November.

Rathbun said the new regulations are “designed to prevent situations like the one in Dimock.” He said the issue there was incomplete casing – Cabot Oil & Gas didn’t use enough cement in the well construction.

DEP in April banned Cabot from drilling in Pennsylvania until it plugs the three wells determined to be leaking gas. Cabot has already paid a $240,000 fine and must pay $30,000 per month until the company meets its obligations.

Rathbun said one well is capped, and Cabot is currently working to cap a second.

He said most of the discussion at the meeting focused on responding to reports of gas migration into water sources.

Currently, the industry is required to report any suspected or confirmed occurrence of gas migration to DEP. The new regulations would require immediately reporting suspected or confirmed migration to DEP and to emergency responders for the affected municipality.

As chairman of the state Environmental Quality Board, Hanger on Monday will present those proposed regulations to the board for adoption. If approved, they will be sent to the House and the Senate Environmental Resources & Energy Committee.

Each legislative committee will have 30 days to review the proposed regulations before either recommending a vote or sending them to the Independent Regulatory Review Commission, which is composed of administrative law judges. A final approval is required from the state attorney general to ensure they are constitutional.

The whole process can take about six months.

Kathryn Klaber, president and executive director of the Marcellus Shale Coalition, which represents the natural gas production industry, said in a written statement that the coalition is “fully committed” to continue working with government regulators to ensure that the potential of the Marcellus Shale in the state is realized in a safe and responsible way.

“Today’s meeting with DEP represents yet another honest and straightforward discussion about the best practices needed to fully achieve this vision. Positive progress on practices relating to the management of historic and naturally occurring shallow gas, as well as other initiatives related to transparency and well integrity, will help our industry continue to strengthen its safety and environmental record while continuing to create tens of thousands of jobs each year for residents of this state,” Klaber said.

Drilling prompts DEP to get Scranton office

Intent is to have inspectors based closer to local gas drilling activity.

For some time, local legislators and environmentalists have complained that local oversight of natural-gas drilling is too difficult because the closest inspectors are in Williamsport.

With the industry preparing to ramp up activities in Susquehanna and Wayne counties, the state Department of Environmental Protection addressed that complaint on Wednesday by announcing the opening of an Oil and Gas Management office in Scranton.

“Our communities need the economic boost that gas drilling will provide, but we simply cannot afford to have state government shortchange oversight,” said state Sen. Lisa Baker, R-Lehman Township, in a news release.

She had asked Gov. Ed Rendell to open an office closer to local drilling activity, the release noted, because “given the increase in drilling activity expected to take place in the region, and the potential environmental consequences of mistakes, long-distance oversight was not an acceptable answer.”

The site hasn’t been finalized, but it will be within the city, according to DEP spokesman Tom Rathbun, and will house 10 employees who have yet to be hired. Most of those will be “field personnel,” Rathbun said, meaning “they’ll be handling inspection and compliance.”

No date has been set for the office’s opening, but Rathbun assured it would be “as soon as possible.”

“We’re anticipating continued growth in Wayne and Susquehanna counties, according to what the industry is reporting, so we’re responding to that,” he said. “That’s based on the industry forecasts where they’re doing next year, what they expect to do.”

Funding for the employees and regional office will be paid for through increased permitting fees the industry is paying to drill in the Marcellus shale, “which was the original intent behind increasing the fees: to make the program pay for itself,” Rathbun said.

The shale is a rock formation a mile underground stretching from New York to Kentucky and is estimated to store enough gas to supply the nation’s current consumption for two decades.

The employees will be part of 68 new DEP hires that Rendell announced last week to handle increased gas drilling, Rathbun said.

Gas wells a mixed blessing on property

Lucrative leasing deals are possible for area residents. Negatives: Noise, pollution.

The opportunity won’t come to most Northeastern Pennsylvania landowners, but those offered a natural-gas well will face life-changing effects, both positive and negative.

“It’s going to transform Pennsylvania, there’s no doubt about it,” said Ken Balliet, a Penn State Cooperative Extension director well-versed in gas-lease issues. “This whole Marcellus shale play is highly speculative” for the gas companies, he said, because it’s not very well studied, but landowners who land lucrative deals will see it otherwise. “When you hand someone a check for half a million dollars, that’s not very speculative.”

Add to that well-siting and annual royalty payments, and suddenly the problem becomes trying to find tax havens for the profits.

The tradeoff, however, is an unexpected and sometimes unwelcome bustling of activity — trucks, noise and pollution. Many of the changes will come and go, but some – like a clear-cut well site or a noisy compression station – will remain for decades.

It’s a sacrifice Jerry Riaubia is willing to make on his 16 acres in Sweet Valley – if the right number is on the checks and they keep coming. “If I had an income for my family, it would be well worth it,” he said. “We could help the economy out if we had that money. It could save our economy.”

For many rural landowners, the offers are difficult to pass up. Reports of leases offered at $2,500 per acre are common as close as Wyoming County, and companies have increased production royalties from the state-mandated 12.5 percent to 18 percent as owners become more educated.

Even with just his 16 acres in a standard 600-acre drilling unit, and estimating modest gas extraction at 18 percent royalties on a single well, Riaubia stands to pocket around $117,000 over the well’s lifetime, according to www.pagaslease.com, a Web site run by landowners who were approached early on about leasing.

That’s only the profits from a single well, and far more than one can exist at a site. “We heard of one company had drilled 27 on one pad,” said Tom Murphy, a Penn State Cooperative Extension educator.

And as oil prices increase, so will natural gas prices, according to a 2005 report by the Schlumberger oil and gas company. “The price of gas is linked to oil and based on each fuel’s heating value,” the report notes. “As long as oil prices remain high, there is no reason for natural gas prices to go down. Although gas is abundant in much of the world, it is expensive and potentially dangerous to transport internationally.”

That financial windfall might be just a pipedream for Luzerne County residents, though.

Chesapeake Energy Corp., one of the largest leaseholders in the Marcellus play, isn’t leasing in the county, according to Matt Sheppard, the company’s director of corporate development. A single listing exists for Luzerne County on the gas lease Web site’s lease tracker. Signed in late May, the five-year offer was $1,500 per acre with 15 percent royalties.

While Riaubia said he hasn’t been approached by any companies, land groups in northern municipalities in the county, such as Franklin Township, have been negotiating. Rod McGuirk, who owns 56 acres in the township, said owners there have been offered $1,800 per acre. “They’re just preliminary offers, but we’re excited,” he said.

That excitement could quickly wane if problems crop up or owners are unprepared for the realities of drilling. Unlike other unconventional gas sources, shale wells produce consistently over three decades, so well sites are more or less permanent. Even after sites are reclaimed, some infrastructure is left behind.

Also, because gas is transported nationally through lines that are more compressed than regional distribution lines, noisy compression stations will need to be installed in what are otherwise bucolically quiet locales.

Then there’s the potential to unearth radioactive materials, acid-producing minerals and deplete water resources. In fact, after concerns arose about the amount of water necessary to drill a well, the state Department of Environmental Protection included an addendum to its drilling permit that addresses water usage and is specific to Marcellus shale.

Still, officials assure that regulatory agencies are keeping tabs on drillers. “There’s an awful lot of eyes watching the streams up there,” DEP spokesman Tom Rathbun said. “So these guys aren’t just going to be able to dump stuff. … If they start killing streams, a lot of people are going to find out quickly.”

And aside from that, he said, the financials force the industry to regulate itself. “The Marcellus shale is not really a business for fly-by-nighters,” he said. “You don’t throw $10 million away because you were cutting corners on an environmental regulation. Now that they know we’re watching … there’s too much money on the line for these guys to do stupid mistakes or to cut corners.”
